[Data collection and processing] Data collection, storage and use is necessary to provide the proper service requested by the client. The information collected are processed by officers authorized to use the personal data, and if required, transmit to third parties providing different kinds of services (institutions, public authorities, services providers, approved institutions) related to the request of the client. The client shall be responsible for the accuracy and correctness of the personal information provided.
[Purposes] Personal information will be collected, processed and stored for the following purposes: 1) performance of the contractual obligations related to the services requested; 2) administrative or financial; 3) client’s information form; 4) documentation and archiving; 5) promotional initiatives related to the services offered by the Controller; and 6) promotional initiatives of the Controller related to third party activities.
[Legal basis for the collection, processing and storage] For general data: 1) the necessity to inform and coordinate with the client in relation to the subscribed service; 2) the consent to process the personal data given by the client. For particular data categories: 1) the client has openly made his/her data public. For promotional purposes: 1) the consent by the client; 2) the legitimate interest of the data Controller related to the promotion of their activities.
[Data processing and storage location] Data processing and storage, filing or computerized, is possible at the Controller’s office or any other place where the operator involved might be located. Data processed online or on virtual platforms (e.g. Squarespace, Facebook, Google, Yahoo, Microsoft, Dropbox) can be stored by them, also outside of the Philippines. As far as the data is stored by the Controller, it will be stored for the period of time necessary to allow the correct performance of the activities required, with the exception of those data kept for reasons of legal or contract obligations.
[Rights] The client has the right to 1) obtain: the confirmation of the existence or absence of his/her personal data, even if not yet recorded, the access to his/her personal data, the correction of personal data without delay, the cancellation of personal data without delay in case they are no longer necessary or in case their treatment is presumed to be unlawful, the limitation of the use of the data for the time necessary to the Controller to make the requested verifications; 2) revoke the consent previously given regarding the data processing, at any time, with no prejudice to the lawfulness of the treatment that took place before the revocation; 3) object, for personal reasons, to the processing of his/her personal data. In this case the Controller should stop any further treatment of the data, unless the Controller can prove the existence of lawful reasons to proceed with the treatment. If the data are treated for promotional purposes of activities or services provided by the Controller, the client has the right to object at any time to the treatment of his/her data for this kind of purposes, including marketing profiling. In case the client objects to the treatment for direct marketing use, his/her personal data cannot be used for such purposes ; 4) file a claim with a control Authority.
